What's In A Name? ... Trademark Opportunities

What's in a name? Well, if you are talking trademarks, there's an awful lot. According to the United States Patent and Trademark Office, trademark is a word, phrase, symbol or design, or a combination of words, phrases, symbols or designs, that identifies and distinguishes the source of the goods of one party from those of others. It is also possible to receive trademark status for identification that is not on its face distinct or unique but which has developed a secondary meaning over time that identifies it with the product or seller.

Friday, through the intrepid investigative powers of the ClayNation, we learned and now celebrate the discovery that Clay has filed for and received trademark protection on the name Clay Aiken^(tm). Not only is our Clayton beautiful, sexy and gifted with a huge... voice (what did you think we were gonna say?), but he is also well endowed in the cranium.

In addition, our clever Clayton has also filed to trademark commonly used fandom terms such as ClayNation, Claymania, Claymates, Clayvention, Clayniacs, and yes, even the term cellcert among others.
